Preliminary Information Form for Distance Sales Agreement

This Preliminary Information Form ("Pre-Information") has been prepared to inform the buyer ("BUYER"), whose details are listed below, regarding the terms of the Distance Sales Agreement ("Agreement") made with HAREM ÇİKOLATA SANAYİ A.Ş. ("SELLER"), as well as to provide details about the basic characteristics of the product(s), the sales price, payment method, delivery terms, and the right of withdrawal. This Pre-Information serves as a pre-contractual notice under the Law No. 6502 on Consumer Protection, published in the Official Gazette dated November 28, 2013 and numbered 28835, and the Distance Contracts Regulation published in the Official Gazette dated November 27, 2014 and numbered 29188.

In this Pre-Information, the Buyer and Seller shall be referred to individually as a "Party" and collectively as the "Parties".

3. Delivery Terms
The Seller shall deliver the products to the address stated in Article 1 following the completion of payment.

4. Payment Terms
The Buyer shall make payment via credit card or a similar electronic method to the Seller.

5. Right of Withdrawal
The Buyer has the right to withdraw from the contract without providing any justification or incurring penalties within 14 days from receipt of the goods.

To exercise the right of withdrawal, the Buyer must notify the Seller via mail, telephone, fax, or e-mail within 14 days from delivery. The Buyer may use the withdrawal form attached to the Agreement or submit a clear statement of their decision.

The Buyer is required to return the product to the Seller within ten days from the date of withdrawal. If the product has been used contrary to the nature, technical specifications, or user manual, the Buyer shall be responsible for any depreciation in value.

A decrease in value or impossibility of return does not preclude withdrawal unless caused by the Buyer, in which case the Buyer is liable.

The Seller shall refund the Buyer within 14 days of receiving the notice of withdrawal, provided that the returned goods are also received.

6. Products Not Subject to Withdrawal
Under the Distance Contracts Regulation, the Buyer may not withdraw from:

  • Products with price fluctuations beyond the seller's control

  • Custom-made or personalized goods

  • Perishables or goods with a short shelf life

  • Goods unsealed after delivery that are unsuitable for return for hygiene reasons

  • Goods mixed inseparably with others after delivery

  • Books, digital content, software, etc. if the seal is broken

  • Periodicals such as newspapers or magazines

  • Leisure services tied to specific dates (e.g. travel, dining, accommodation)

  • Digital goods delivered immediately online

  • Services started with consumer's consent before withdrawal period ends

Withdrawal for items such as software, CDs, DVDs, cosmetics etc. is only possible if the packaging is unopened and the item unused.

7. Other Provisions

7.1. The Buyer is deemed to have accepted the product as undamaged if they fail to inspect it upon delivery.
7.2. Delivery is conditional upon electronic confirmation of the contract and full payment.
7.3. If a product is delivered that was not purchased, the Buyer must return it to the Seller; return shipping is at the Seller's expense.
7.4. If delivery is not possible due to stock depletion or force majeure, the Seller shall inform the Buyer and refund the payment.
7.5. The Buyer confirms all information provided is accurate and accepts liability for damages resulting from errors.
7.6. Complaints can be submitted to the contact information in Article 1 or to the consumer arbitration committee or court with jurisdiction based on value thresholds set annually by the Ministry.

In 2023, the monetary limit for consumer arbitration boards is 66,000 TRY.
